These Terms of Service govern your use of the Delivery Signal platform and diagnostic check services, operated by Delivery Signal (ABN 77 301 044 948), Victoria, Australia.

By creating an account or using the service, you agree to these terms.
If you are using the service on behalf of an organisation, you confirm that you have authority to bind that organisation to these terms.
These terms are governed by the laws of Victoria, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Victoria.
Delivery Signal provides diagnostic tools that allow authorised users to invite stakeholders, staff, managers, consultants, clients or other participants to complete structured surveys.
The platform generates scored diagnostic reports based on aggregated responses.

The service includes access to the platform, survey management, report generation and email delivery of invitations, reminders and report notifications.
Features available depend on your plan, product type, configuration and any applicable commercial arrangement.
You are responsible for maintaining the security of your account credentials.
You must notify us immediately at hello@delivery-signal.com if you suspect unauthorised access.
You must not share your account with others or create accounts on behalf of third parties without their knowledge.
You must not use the platform to invite respondents unless you have a proper basis to do so.
We reserve the right to suspend or terminate accounts that violate these terms or are used in a way that could harm other users, respondents, organisations or the service.
Payments are processed by Stripe, Inc.
By making a purchase, you agree to Stripe's applicable terms of service.
Delivery Signal does not store payment card details. All card data is handled directly by Stripe's secure payment infrastructure.
All prices are in Australian dollars and are inclusive of GST where applicable.
A tax invoice will be issued for each purchase.
Subscription plans, where available, are billed in advance on a recurring basis.
You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period and you will retain access until that date.
We reserve the right to change pricing with reasonable notice. Price changes will not affect the current billing period for active subscriptions.
Access to report generation may require a report credit, subscription entitlement or other paid access right.
Credits are purchased in advance and consumed when a report is first generated for a check, unless otherwise stated at the time of purchase.
Regenerating a report within the same open check does not consume an additional credit unless otherwise stated.
Credits are non-refundable once consumed.
Unused credits do not expire, except where otherwise stated at the time of purchase.
Trial credits or free checks may be provided at our discretion and are subject to availability. We reserve the right to modify or withdraw trial offers at any time.
We will not cancel purchased unused credits without providing a refund or equivalent alternative.
Unused report credits may be refunded within 30 days of purchase, subject to a request to hello@delivery-signal.com.
Credits that have been consumed are non-refundable.
If a technical fault attributable to Delivery Signal prevents report generation and a credit is consumed, we will restore the credit or provide a refund at our discretion.
Nothing in this policy affects any rights you may have under the Australian Consumer Law.

When you invite respondents to a Delivery Signal diagnostic check, you are responsible for ensuring they understand:
Delivery Signal does not require respondents to create accounts.
Respondents access surveys via a unique link.
Survey responses are stored without names or email addresses attached to individual answers.
Some Delivery Signal products support multi-level reporting.
Multi-level reporting may allow authorised users to view results by approved hierarchy levels, such as organisation, division, branch, team, location, workstream, practice area, PMO, function or other reporting node.
You are responsible for setting up hierarchy structures, respondent groups and report access in a way that is accurate, lawful and respectful of respondent anonymity.
Delivery Signal may suppress, limit or generalise outputs where a group is too small, too identifiable or otherwise unsuitable for anonymous reporting.
You must not use multi-level reporting to identify, isolate or target individual respondents.
The Delivery Signal platform, methodology, scoring models, product configuration, report templates, prompts, software, design, brand and associated materials are owned by Delivery Signal.
You are granted a limited, non-exclusive, non-transferable licence to use the service for your internal business purposes or authorised client work, subject to your plan or commercial arrangement.
Diagnostic reports generated from your submitted data are yours to use and share within your organisation and with authorised stakeholders, subject to confidentiality and any applicable restrictions.
You may not resell, sublicense or commercially redistribute reports as a standalone product unless expressly authorised in writing by Delivery Signal.
You may not use Delivery Signal reports, scoring models, prompts, templates or outputs to build or train a competing product.
Content you submit to the platform, including organisation names, check names, hierarchy structures and free-text responses, remains yours or the relevant respondent's.
You grant Delivery Signal a limited licence to use that content to provide, secure, improve and support the service.
Narrative sections of diagnostic reports may be generated or assisted by artificial intelligence.
AI-generated content summarises patterns from diagnostic responses and calculated scores.
AI-generated content should be reviewed by responsible leaders, consultants or authorised report recipients before decisions are made.
Delivery Signal does not warrant that AI-generated content is accurate, complete or suitable for any particular purpose.
To the maximum extent permitted by Australian law, Delivery Signal's total liability for any claim arising from your use of the service is limited to the amount you paid for the service in the three months preceding the claim.
Delivery Signal is not liable for indirect, consequential, incidental or special damages, including loss of profit, loss of data, business interruption, failed change initiatives, project failure, program failure, operational disruption, reputational loss or management decisions arising from use of or reliance on the service or any report generated by the service.
Nothing in these terms excludes any rights you may have under the Australian Consumer Law that cannot be excluded by contract.
Delivery Signal checks are diagnostic tools.
Reports reflect respondent perceptions at a point in time.
Reports are not audits, assurance opinions, professional certifications, legal advice, financial advice, technical certifications, safety certifications or formal independent reviews.
Delivery Signal makes no warranty that use of the service will prevent failure, reduce risk, improve performance, resolve delivery issues or produce any particular organisational outcome.
Reports should be treated as one input into management judgement, governance, review and decision-making.
We may update these terms from time to time.
Material changes will be communicated by email or displayed within the platform with reasonable notice.
Continued use of the service after changes take effect constitutes acceptance.
We may modify, add or discontinue features of the service with reasonable notice.
We will not delete purchased unused credits without a refund or equivalent alternative.
